Fundraiser Terms, Conditions & Liability Waiver
By registering and participating in a “Fundraise Your Way” event in support of Fraser Coast Hospice, you acknowledge and agree to the following terms and conditions:
1. Independent Fundraising Activity
The organiser acknowledges that their fundraising activity is independently organised and conducted by the fundraiser and is not managed, supervised, controlled or operated by Fraser Coast Hospice.
The fundraiser agrees they are solely responsible for:
- Planning and conducting the event or activity;
- Obtaining any necessary permits, licences or approvals;
- Ensuring compliance with all applicable laws and regulations;
- The safety of all participants, volunteers and attendees;
- Managing all event risks and public safety requirements.
2. Assumption of Risk
The organiser understands and acknowledges that participation in fundraising activities may involve certain risks, including but not limited to injury, illness, property damage or loss.
The organiser voluntarily assumes all risks associated with the fundraising activity and participation in the event.
3. Release and Indemnity
To the fullest extent permitted by law, the organiser agrees to release, indemnify and hold harmless Fraser Coast Hospice its employees, volunteers, directors, representatives and affiliates from and against any and all claims, liabilities, losses, damages, expenses or legal actions arising from or connected with:
- The fundraising activity or event;
- Any injury, illness, death or property damage;
- Any act or omission by the organiser, participants or third parties;
- Any breach of laws, permits or regulations.
This release applies whether the claim arises before, during or after the fundraising activity.
4. Insurance
The organiser acknowledges that Fraser Coast Hospice does not provide insurance coverage for independently organised fundraising activities.
The organiser is responsible for obtaining any appropriate insurance coverage, including public liability insurance where required.
5. Use of Funds
The organiser agrees that all funds raised in connection with the fundraiser will be handled honestly and transparently and remitted to Fraser Coast Hospice within the agreed timeframe.
6. Use of Name and Branding
The organiser may only use approved logos, branding and promotional materials supplied by Fraser Coast Hospice and must not imply that the fundraiser is officially organised or managed by the Hospice.
7. Right to Refuse or Cancel
Fraser Coast Hospice reserves the right to decline, withdraw or cancel approval for any fundraising activity that may damage the reputation, values or integrity of the organisation.
8. Privacy
Personal information collected during the fundraising process will be handled in accordance with applicable privacy laws and the Hospice’s privacy policy.
9. Agreement
By registering a fundraiser, the organiser confirms that they:
- Have read and understood these terms and conditions;
- Agree to comply with all requirements outlined above; and
- Accept full responsibility for their fundraising activity.
